Personal Information
We do not collect any personal information from you unless you voluntarily provide it to us.

When you sign up to become a user of the Site (a “User”), you will be asked to provide us with certain personal information, such as your first name, last name, email address, telephone number and, if you order or ship a physical item, your postal or shipping address. In this Privacy Policy, we refer to this information as “Personal Information.” If you complete your Profile on the Site, you may also provide a bio and picture of yourself. If you complete a Listing on the Site, you will be asked to provide a description of your relationship with the Listing. In this Privacy Policy, we refer to this information as “Profile Information.” Profile Information will be made public and will be viewable by other Users of the Site.

Information Provided by Managers and Other Team Members
Ghostnote allows Artists to work with Managers and Assistants (together, “team members”) who act on the Artist’s behalf within the Services. If a Manager creates an account on your behalf, or a team member works on items associated with your account, the Manager or team member may provide us with Personal Information and Profile Information about you, such as your legal and professional name, contact information, biographical information, images, and information about items associated with you. If you are a Manager or Assistant and you provide us with information about an Artist or another person, you represent that you are authorized to do so.

When a Manager invites an Artist to claim an account, or invites an Assistant to join a team, we collect the name and e-mail address or telephone number the Manager provides so that we can send the invitation. When you request management capability, we collect information about you and the Artists you represent, which we use to review your request, and we may ask you to verify your identity.

Activity and Delegation Records
We keep records of the actions taken in each account, including which User took each action, the Artist account on whose behalf it was taken, the Role and Delegation under which it was taken, when it was taken, and changes to Roles, Delegations and account settings. We use these records to operate the Services, to show Artists and Managers who did what on their accounts, to confirm that actions were authorized, for security and fraud prevention, and to enforce our Terms and Conditions of Use.

Usage Information
We use automatic data collection technology when you visit the Site to record information that identifies your computer, to track your use of our Site, and to collect certain basic information about you and your surfing habits. This information includes information about your operating system, your IP addresses, browser type and language, referring and exit pages and URLs, keywords, date and time, amount of time spent on particular pages, what sections of a website you visit, and similar information concerning your use of the Site and the Services (the “Usage Information”).

We collect this Usage Information by using cookies and pixel tags (also called web beacons or clear gifs). Cookies are small packets of data that a website stores on your computer’s hard drive so that your computer will “remember” information about your visit. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of website users. You can reject cookies by following the directions provided in your Internet provider’s “help” file. If you reject cookies, you may still visit the Site, but may not be able to use some areas of the Site and/or the Services.

We do not collect Personal Information in this way, but if you’ve provided us with Personal Information, we may associate that information with the information that is collected automatically. Automatic data collection may be performed on our behalf by our service providers. We also use third-party service providers for infrastructure hosting, product analytics and error monitoring. We limit the Personal Information those providers receive to what is necessary for them to perform their function, and where practical we identify you to them only by a pseudonymous account identifier rather than by your name or e-mail address.

If you choose to purchase or subscribe to a feature or Service of Ghostnote that requires a fee, you will be required to provide us with your payment information, including, without limitation, bank account numbers, credit card or debit card numbers, account details, ACH information, and similar data (collectively, “Payment Information”).

The Services have certain optional features which, if used by you, require us to collect additional information to provide such features, such as intermittent access to your device’s camera and photo library. You will be notified of such collection, as appropriate. If you choose not to provide the information needed to use a feature, you will be unable to use the feature.

Location Information
We may collect and use coarse location information from your device with your permission when you choose to use certain location-related features. There are certain settings relating to location-related information which you can find in your device settings or the in-app settings, such as location sharing. We may also use your location information for diagnostics and troubleshooting purposes.

We may use your Personal Information and Usage Information in a manner that is consistent with this Privacy Policy and the context of our relationship with you. We will use your Personal Information and Usage Information collected through the Site for the following purposes:

• To identify you when you sign in to your account;
• To respond to your requests and to provide you with the Services;
• To respond to your inquiries and contact you about changes to the Site and/or the Services;
• To send you notices (for example, in the form of e-mails, SMS or MMS text messages, rich media messages, telephone calls, push notifications, mailings, and the like) regarding products, offers or services you are receiving, and for billing and collection purposes;
• To send you information we think you may find useful or that you have requested from us;
• To enhance and improve the Site or the Services, such as through personalized features and content;
• To analyze the use of the Site and the Services and the people visiting to improve our content and Site and the Services;
• To investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our policies, or as otherwise required by law;
• To review requests for management capability, to administer Roles and Delegations (including verifying that a User is authorized to act on behalf of an Artist), and to maintain records of actions taken under Delegation;
• For any other purposes disclosed at the time the information is collected or to which you consent; and
• As otherwise specifically described in this Privacy Policy.

We will use your Payment Information to process your authorized payments for our Services.

We do not disclose your Personal Information to third parties for their direct marketing purposes. Without limiting the foregoing, we will not sell, rent, or share your mobile telephone number or any data obtained through mobile opt-in consent with third parties or affiliates for their marketing or promotional purposes. We may share your mobile telephone number with service providers who assist us in delivering communications (e.g., messaging platform providers), solely for the purpose of facilitating our communications with you and subject to contractual obligations to maintain the confidentiality of your information.

We sometimes hire other companies to perform certain business-related functions. Examples include hosting and infrastructure services, sending e-mail and text messages on our behalf, product analytics and error monitoring, maintaining databases, processing payments, verifying identity, and shipping and delivering physical items. When we employ another company to perform a function of this nature, we provide them with the information that they need to perform their specific function, which may include Personal Information. We require these service providers to use Personal Information only to perform services for us, to keep it confidential, and to protect it with appropriate safeguards. Where we ship a physical item to you, we share your name, shipping address and, where the carrier requires it, your telephone number or e-mail address with our shipping carriers (such as UPS) solely for the purpose of delivering the shipment.

Sharing Within Artist Teams. If you are an Artist who works with Managers or Assistants, information in your account will be visible to, and may be acted on by, those team members to the extent permitted by their Role. For a Primary Manager, this may include your payout, banking and Stripe Connect settings.

If we or all or substantially all of our assets are acquired, we expect that the information that we have collected, including Personal Information, would be transferred along with our other business assets.

We may disclose your Personal Information and Usage Information to government authorities and to other third parties when compelled to do so by government authorities, at our discretion, or otherwise as required by law, including but not limited to in response to court orders and subpoenas. We may also disclose your Personal Information and Usage Information when we have reason to believe that someone is or may be causing injury to or interference with our rights or property, other users of this Site, or anyone else that could be harmed by such activities.

We will share your Payment Information with a third-party service provider as necessary to process your payment. The third-party service provider stores your Payment Information; we do not store this information. Storage by the third-party service provider of your Payment Information is subject to the privacy policies and practices of the third-party service provider and is not subject to the terms of this Privacy Policy. By providing your Payment Information, you acknowledge and agree to use of such information by the third-party service provider for purposes of processing your payment to us.

We use Stripe for identity document verification. Stripe collects identity document images, facial images, ID numbers and addresses as well as advanced fraud signals and information about the devices that connect to its services. Stripe shares this information with us and also uses this information to operate and improve the services it provides, including for fraud detection. You may also choose to allow Stripe to use your data to improve Stripe’s biometric verification technology. You can learn more about Stripe and read its privacy policy at https://stripe.com/privacy.

We take commercially reasonable steps to protect the Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail sent to or from us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

We may continue to retain your information or information about you even after you request deletion of your data if such retention is reasonably necessary to comply with our legal obligations, to resolve disputes, prevent fraud and abuse, enforce our Terms and Conditions of Use or other agreements, maintain the Services and/or protect our legal rights and other interests. This includes the activity and Delegation records described above, which we may retain after a Delegation is revoked or an account is closed.

We use Stripe for identity document verification. Stripe retains a copy of all the data provided as part of a verification. You may also have consented to allow Stripe to use your data to improve their technology. You can delete your information from Stripe’s servers or revoke your consent by visiting https://support.stripe.com.

You may update the information that is stored in your user account by visiting your Ghostnote Profile or by e-mailing us at Ghostnote Info. If you are an Artist, you can view the Managers and Assistants with access to your account, and revoke their access, through your account settings.

If you wish to stop receiving promotional communications, you have the following options: (a) for text messages, reply “STOP” to any text message received from us; (b) for e-mails, follow the unsubscribe instructions included in each email; (c) for telephone calls, inform us during any call that you wish to opt out, or contact us as described below; or (d) for any communication type, visit your Ghostnote Profile, adjust your notification preferences in your account settings, or e-mail us at support@ghostnote.com. For help or information regarding our messaging program, reply “HELP” to any text message or contact support@ghostnote.com. Message frequency varies. Message and data rates may apply. Subject to our retention rights, including, without limitation those set forth in section 5 hereinabove, you may request to delete your account via the Website and/or by contacting customer support.

The Site may contain content, services, advertising and other materials that link to websites operated by third parties. We have no control over those other sites, and this Privacy Policy does not apply to them. Please refer to the privacy policies of those sites for more information on how the operators of those sites collect and use your Personal Information.

Under California Civil Code Section 1798.83, California residents who have an established business relationship with us may choose to opt out of our sharing their contact information with third parties for direct marketing purposes. If you are a California resident and you wish to opt out, please send an e-mail to Ghostnote Info.

We do not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.

The Site and the Services are operated in the United States. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By providing us with any information through the Site or the Services, you consent to this transfer.

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time and will post any changes on the Site as soon as they go into effect. By accessing the Site or using the Services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please refer back to this Privacy Policy on a regular basis.
